These Terms and Conditions govern access to and use of the Nemet platform, available at nemet.health and its related subdomains, including the web dashboard, mobile application, and any other associated service.
Nemet is a technology platform developed and operated by Mythology Labs SRL, a company incorporated in Uruguay, with registered address at Ramón Anador 3822 A, Montevideo, Uruguay.
By registering, purchasing, accessing, or using Nemet, the user declares that they have read, understood, and accepted these Terms and Conditions. If they do not agree with them, they must not use the platform.
1. Definitions
For the purposes of these Terms:
- Nemet refers to the technology platform, application, web dashboard, digital services, features, documentation, and associated tools.
- Mythology Labs, “we,” “us,” or “the company” refers to Mythology Labs SRL, owner and operator of Nemet.
- Client refers to the independent professional, office, clinic, institution, or company that purchases a Nemet subscription.
- Professional user refers to the psychologist, psychiatrist, mental health professional, office administrator, or other user authorized by the Client to use the platform.
- Patient refers to the person invited by a Professional user or Client to use certain Nemet features, such as answering forms or accessing information shared by their professional.
- Client Data refers to the information uploaded, generated, or managed by the Client, Professional user, or Patient within
2. Nature of the service
Nemet is a B2B SaaS platform aimed at mental health professionals and organizations. Its purpose is to provide technological tools to facilitate the organization, follow-up, and management of information related to patients, forms, responses, scheduling, communications, and other operational or clinical-administrative processes.
Nemet does not provide medical, psychological, psychiatric, therapeutic, or healthcare services.
Nemet does not diagnose, treat, prescribe treatments, recommend clinical interventions, replace professional judgment, or constitute medical, psychological, or healthcare advice.
Clinical, diagnostic, therapeutic, follow-up, or intervention decisions are the sole responsibility of the treating professional or responsible institution.
3. Professional use of the platform
Nemet is intended for use by professionals, offices, clinics, and institutions.
The Client declares that they and/or the Professional users who use the platform have the qualifications, training, permits, licenses, registrations, or authorizations necessary to practice their activity in the corresponding jurisdiction.
For the purposes of these Terms:
- The professional relationship with their patients.
- Obtaining the consents, authorizations, or legal bases necessary to upload and process patient data.
- The accuracy, relevance, and legality of the information uploaded to the platform.
- The clinical or professional use they make of the information available in Nemet.
- Compliance with the professional, ethical, healthcare, and data protection rules applicable in their country or jurisdiction.
4. Use by invited patients
Patients do not purchase Nemet directly, unless expressly stated otherwise. Their access to the platform is by invitation or instruction from a Client or Professional user.
The Patient acknowledges that Nemet is a supporting technology tool and that any consultation, urgent matter, emergency, clinical interpretation, or decision regarding their health must be handled directly with their treating professional or with the corresponding medical/emergency services.
Nemet must not be used as an emergency channel.
5. Registration and access
To use Nemet, the Client or Professional user must create an account or receive access credentials. The user agrees to provide truthful, up-to-date, and complete information.
The user is responsible for maintaining the confidentiality of their credentials and for all activities carried out from their account.
The user must notify us immediately of any suspected unauthorized access, loss of credentials, or security incident by writing to:soporte@mythologylabs.com.uy.
6. Plans, subscriptions, and payments
Nemet is offered under a subscription model, according to the plans, prices, features, limits, and conditions published on the website or communicated commercially.
Plans may vary depending on the type of Client, number of professionals, included patients, available features, support, integrations, or other commercial criteria.
Purchasing a plan implies acceptance of the corresponding price, billing frequency, limits, and conditions.
When payments are made through a payment platform, the charge may be processed by such platform as Merchant of Record, subject to its own terms, billing processes, applicable taxes, and available payment methods.
The payment platform may send receipts, proofs of payment, and communications associated with the payment.
By default, it may send customers transaction receipts and instructions related to purchased products.
Published prices may not include taxes, fees, withholdings, bank charges, or applicable duties, unless expressly stated otherwise. Applicable taxes may be calculated and added during the payment process based on the buyer’s location and current regulations.
7. Subscription renewal and cancellation
Unless otherwise indicated, subscriptions renew automatically at the end of each billing period.
The Client may cancel their subscription before the next billing cycle through the enabled means or by requesting it atsoporte@mythologylabs.com.uy.
Cancellation prevents future charges, but does not automatically generate a refund for periods already started, unless applicable under the Refund and Cancellation Policy, agreed specific conditions, or applicable law.
After cancellation, the Client may retain access to the platform until the end of the already paid period, unless otherwise indicated or there is a breach of these Terms.
8. Free trials, demos, or promotional benefits
Nemet may offer free trials, demos, discounts, promotional plans, or launch benefits.
The conditions of each promotion will be communicated in due course and may include restrictions on time, features, number of users, number of patients, or other limits.
Unless expressly stated otherwise, a free demo does not imply a purchase, automatic charge, or purchase obligation.
9. Permitted use
The user agrees to use Nemet lawfully, professionally, responsibly, and in accordance with these Terms.
The following is prohibited:
- Using Nemet for unlawful, fraudulent, abusive, or unauthorized purposes.
- Uploading false, misleading, offensive, discriminatory, or illegal information.
- Using the platform to provide unauthorized services or services outside the corresponding professional framework.
- Attempting to access unauthorized accounts, data, systems, or areas.
- Reverse engineering, copying, modifying, reselling, sublicensing, or commercially exploiting the platform without authorization.
- Interfering with the operation, security, or availability of Nemet.
- Using the platform as a medical, psychological, or psychiatric emergency system.
- Using the platform to automate clinical decisions without professional review.
10. Data, confidentiality, and privacy
The processing of personal data and sensitive data is governed by our Privacy Policy, available at:https://nemet.health/politica-privacidad.
The Client acknowledges that they may upload or manage personal data and sensitive patient data on the platform, including information related to mental health. The Client is responsible for having the necessary authorizations, consents, contracts, or legal bases for such processing.
Mythology Labs will implement reasonable technical and organizational measures to protect the confidentiality, integrity, and availability of information, without prejudice to the fact that no system can guarantee absolute security.
Mythology Labs will not use patient data for purposes unrelated to the provision, maintenance, security, support, or improvement of Nemet, except with express authorization, legal obligation, or as provided in the Privacy Policy.
11. Client’s professional responsibility
The Client and Professional users are solely responsible for the interpretation, analysis, and use of the information recorded or generated in Nemet.
Nemet may facilitate the visualization, recording, organization, or follow-up of information, but it does not replace professional assessment or the relationship between professional and patient.
The Client must verify relevant information before making clinical, administrative, or professional decisions.
12. Emergencies
Nemet is not an emergency, urgent care, crisis, suicide prevention, or immediate assistance service.
Users and patients facing a medical, psychological, psychiatric, or risk-related emergency must immediately contact local emergency services, go to a healthcare center, or contact their treating professional through the appropriate channels.
13. Availability and changes to the platform
Mythology Labs will seek to keep Nemet available and operational, but does not guarantee uninterrupted, error-free, or permanent availability.
We may perform maintenance, updates, improvements, corrections, or modifications to the platform. Where reasonably possible, we will seek to minimize the impact on users.
Mythology Labs may modify, add, or remove features, while seeking not to substantially affect the contracted services without reasonable prior notice.
14. Support
Support will be provided through the channels communicated on the website, on the platform, or in the conditions of each plan.
Support times, channels, and scope may vary depending on the purchased plan.
Support does not include medical, psychological, psychiatric, clinical, legal, accounting, or regulatory advice.
15. Intellectual property
Nemet, including its software, design, brand, trade name, interfaces, features, databases, code, documentation, content, texts, graphics, and other associated elements, is the property of Mythology Labs SRL or its licensors.
Use of the platform does not transfer to the Client or users any intellectual property rights over Nemet.
The Client retains the rights over their own data, content, and information uploaded to the platform, without prejudice to the authorizations necessary for Mythology Labs to provide the service.
16. Integrations and third parties
Nemet may integrate with third-party services, such as infrastructure, authentication, email, analytics, monitoring, payment providers, or other technology services.
Use of third-party services may be subject to those providers’ own terms and policies. Mythology Labs will not be responsible for interruptions, changes, or failures attributable exclusively to third parties.
When a platform is used for payments, the checkout process, billing, receipts, taxes, payment methods, and certain aspects of transactional support may be subject to that platform’s conditions.
17. Account suspension or termination
Mythology Labs may suspend or terminate access for a Client or user when:
- There is a breach of these Terms.
- Abusive, unlawful, risky, or unauthorized use is detected.
- There are overdue or failed payments.
- It is required by law, competent authority, or relevant provider.
- Risks to the security, privacy, or integrity of the platform are detected.
Where reasonably possible, the Client will be notified before suspension or termination.
18. Limitation of liability
To the fullest extent permitted by applicable law, Mythology Labs will not be liable for indirect damages, loss of profits, loss of revenue, loss of data, loss of opportunity, reputational damage, business interruption, or consequences arising from improper use of the platform.
Mythology Labs’ total liability to the Client for any claim related to Nemet will not exceed the amount effectively paid by the Client during the last three months prior to the event giving rise to the claim, unless applicable law provides otherwise.
Nothing in these Terms will limit liabilities that cannot be legally limited.
19. Changes to these Terms
We may update these Terms from time to time to reflect changes to the platform, legal requirements, commercial conditions, or operational improvements.
The current version will be available on the website. When changes are relevant, we will seek to notify Clients through reasonable means.
Continued use of Nemet after the changes become effective implies acceptance of the new Terms.
20. Governing law and jurisdiction
These Terms will be governed by the laws of the Oriental Republic of Uruguay, unless mandatory consumer protection, data protection, or other applicable provisions establish otherwise.
Any dispute arising from these Terms will be submitted to the competent courts of Montevideo, Uruguay, unless mandatory legal provisions state otherwise.
